Terms of Use

These Terms of Use (“Terms”) govern your use of the Pinned Eats mobile app and website (together, the “Service”), operated by Pinned Eats (“we,” “us,” or “our”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you don’t agree, please don’t use the Service.

1. Who can use the Service

You must be at least 13 years old to use Pinned Eats. If you are under the age of majority where you live, you may only use the Service with the involvement of a parent or guardian. By using the Service, you represent that you meet these requirements.

2. Your account

You’re responsible for the information you provide, for keeping your login credentials secure, and for all activity under your account. Provide accurate information and keep it up to date. Notify us promptly if you suspect unauthorized use of your account.

3. Content you post

You keep ownership of the reviews, photos, spots, and other content you submit (“User Content”). By posting it, you grant us a worldwide, non-exclusive, royalty-free license to host, display, reproduce, and distribute that content within the Service and for its promotion. You represent that you have the rights to what you post and that it doesn’t violate anyone’s rights or the law.

Because Pinned Eats is community-built, spots, “live” statuses, and other User Content are submitted by users and may be inaccurate, incomplete, or out of date. We don’t verify User Content and aren’t responsible for it. Use your own judgment before relying on it.

4. Community rules & objectionable content

We have zero tolerance for objectionable content or abusive behavior. Content that violates these rules — and users who post it — will be removed from the Service.

You agree not to post or do anything that:

5. Reporting, blocking, and moderation

Every review, spot, photo, check-in, and user can be reported from within the app. You can also block another user, which hides their reviews, photos, and other content from you. To report or block, use the options provided on the item or profile in question.

We review reports of objectionable content and abusive behavior and will take appropriate action — including removing the content and suspending or terminating the responsible account — within 24 hours. We may also remove content or suspend accounts at our discretion, with or without notice, to enforce these Terms or protect the community.

6. Acceptable use

Use the Service only for its intended purpose and in compliance with these Terms and applicable law. Don’t misuse the reporting tools, interfere with other users, or attempt to access accounts or data that aren’t yours.

7. Location services

Certain features of the Service require access to your device’s location. By enabling location permissions, you allow Pinned Eats to use your location to display nearby spots, update your live location (if you choose to go live), and improve your experience. You can disable location access at any time in your device settings, although some features may no longer function properly.

8. Business listings

Business listings, operating hours, menus, prices, and availability are provided by business owners or community members and may change without notice. Pinned Eats does not guarantee the accuracy or availability of any listing and is not responsible for business operations, products, or services.

9. No emergency reliance

You should not rely on the Service for emergency purposes or as a guarantee that a business or food truck is present at a particular location or time.

10. Our intellectual property

The Service, including its name, logo, design, and software (excluding User Content), belongs to Pinned Eats and is protected by law. We grant you a limited, personal, non-transferable license to use the Service. You may not copy, modify, or redistribute it except as allowed by these Terms.

11. Reservation of rights

We reserve all rights not expressly granted under these Terms.

12. Copyright complaints

If you believe content on the Service infringes your copyright, please contact us at pinnedeats@pinnedeatsapp.com with sufficient information to identify the material and your copyright. We may remove allegedly infringing content while we investigate, and we may terminate the accounts of repeat infringers.

13. Third-party services

The Service uses third parties such as Apple, Google, mapping providers, and hosting and email providers. Your use of those features may be subject to their terms, and we’re not responsible for third-party services.

14. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don’t warrant that the Service will be uninterrupted, error-free, or that User Content (including spot locations and “live” statuses) is accurate.

15. Limitation of liability

To the fullest extent permitted by law, Pinned Eats and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed one hundred U.S. dollars (US$100).

16. Indemnification

You agree to indemnify and hold harmless Pinned Eats and its operators from any claims, damages, or expenses arising out of your User Content, your use of the Service, or your violation of these Terms or the rights of others.

17. Termination & account deletion

You may stop using the Service and delete your account at any time, from Profile → Delete account in the app or from Account settings on the website. Upon account deletion, your personal information — including your reviews, ratings, saved spots, check-ins, and poll votes — is permanently removed, as described in our Privacy Policy. Spots and polls you added to the community may remain in anonymized form (no longer linked to you). We may retain limited information where required to resolve disputes, prevent fraud, or enforce our agreements.

We may suspend or terminate your access if you violate these Terms or to protect the Service or its users. Sections that by their nature should survive termination (such as content licenses, disclaimers, and limitation of liability) will survive.

18. Governing law

These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in Los Angeles County, California, unless applicable law requires otherwise, and you consent to their jurisdiction.

19. Apple App Store

If you download the app from the Apple App Store, you acknowledge that these Terms are between you and Pinned Eats only, not Apple, and Apple is not responsible for the app or its content. Apple has no obligation to provide support or maintenance for the app. If the app fails to conform to any applicable warranty, you may notify Apple and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation. Apple is not responsible for addressing any claims relating to the app, including product-liability, legal or regulatory, or consumer-protection claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

20. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we’ll update the “Last updated” date above and, where appropriate, notify you in the app. Continued use of the Service after changes take effect means you accept the updated Terms.
